1. Agreement to Terms

By accessing or using the DevHubX ORG website, services, or any related applications (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services. These Terms constitute a legally binding agreement between you ("Client", "User", or "you") and DevHubX ORG ("Company", "we", "us", or "our").

2. Our Services

DevHubX ORG provides website development, web application design, landing page creation, full-stack development, and related digital services. We deliver modern, high-performance websites that convert visitors into customers. All project deliverables, timelines, and pricing will be outlined in individual project agreements or order confirmations.

Service Tiers: We offer three primary service packages — Starter, Professional, and Enterprise. Each package includes specific features, deliverables, and support levels as described on our Services page. Custom solutions are available upon request.

3. User Accounts

To access certain features of our Services, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are solely responsible for safeguarding your password and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

You must be at least 18 years old to use our Services.
You may not share your account credentials with any third party.
We reserve the right to suspend or terminate accounts that violate these Terms.

4. Payments & Billing

All payments for our Services are processed securely through our payment partners. By placing an order, you agree to pay all fees and charges associated with your selected services. Fees are non-refundable except as expressly provided in these Terms or as required by applicable law. For subscription-based services, we will automatically bill your chosen payment method at the beginning of each billing cycle.

One-time Projects: 50% deposit required before work begins, 50% upon completion.
Subscription Plans: Billed monthly or annually, auto-renewing unless cancelled 7 days before renewal.
Late Payments: May result in suspension of services and accrual of interest at 1.5% per month.

5. Intellectual Property

Upon full payment, we grant you a perpetual, worldwide, non-exclusive license to use the custom-developed website or application. All source code, designs, and deliverables created specifically for your project become your property after final payment. However, DevHubX ORG retains ownership of its pre-existing tools, frameworks, libraries, and proprietary code used in development. You retain ownership of all content, images, and data you provide to us.

6. Client Responsibilities

You agree to provide timely feedback, required assets (logos, images, copy, etc.), and access to necessary systems during the development process. Delays caused by client inaction may affect project timelines. We are not liable for delays resulting from your failure to meet responsibilities.

7. Revisions & Approvals

Each project includes a specified number of revision rounds as outlined in your package. Additional revisions may incur extra charges. Final approval must be provided in writing. Once approved, further changes may be subject to additional fees.

8. Limitation of Liability

To the maximum extent permitted by law, DevHubX ORG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of our Services. Our total liability shall not exceed the total amount paid by you to us during the six months prior to the claim.

Disclaimer: Our Services are provided "as is" without warranties of any kind. We do not guarantee that our Services will be uninterrupted, error-free, or free of harmful components.

9. Termination

Either party may terminate a project agreement with written notice. Upon termination, you must pay for all work completed up to the termination date. We may suspend or terminate your access to our Services immediately if you violate these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Delaware.

11. Changes to Terms

We may modify these Terms at any time by posting the updated version on this page. We will notify you of material changes via email or a notice on our website. Your continued use of the Services after changes become effective constitutes acceptance of the new Terms.
